An Indonesian national engaged Australian Migration Lawyers following the refusal of their Protection (subclass 866) visa application by the Department. The primary application, lodged in August 2024, had relied entirely on a political opinion claim relating to the Free Papua Movement, which the Department found lacked credibility and subsequently refused in January 2025.
Deep cultural stigma and intense personal anxiety had initially prevented the client from disclosing the true basis of their fear. Upon entering the merits review stage at the Administrative Review Tribunal (ART), the client disclosed to our team that they are a homosexual man who faces a well-founded fear of persecution if returned to Indonesia. AML took over representation at the ART stage, tasked with the complex challenge of completely reframing the case strategy and overcoming the significant credibility hurdles caused by the late disclosure of these claims.
Our legal team, led by Senior Associate Walt Calis, executed a comprehensive restructuring of the case presentation upon being engaged in August 2025. Recognising the delicacy of shifting from a discredited political claim to a sexual orientation claim, we prioritised building a transparent, supportive rapport with the client to understand their story fully.
Annalise conducted exhaustive country research to compile highly detailed submissions, filed in November 2025 - outlining the objective legal and societal perils faced by LGBTQIA+ individuals in Indonesia. Walt formulated a precise legal framework addressing the psychological and cultural reasons behind the client's delayed disclosure. He then thoroughly prepared the client for the emotional rigour of the Tribunal environment and provided expert oral advocacy during the ART hearing in April 2026, ensuring the client's genuine voice was clearly articulated and legally protected.
In April 2026, just eight months after AML was engaged to prepare and advance the new claims, the Administrative Review Tribunal successfully set aside the Department’s original refusal. The matter was remitted with the explicit direction that the applicant satisfies the refugee criterion under section 36(2)(a) of the Migration Act.
The Tribunal Member fully accepted the client's identity as a homosexual man and agreed that he would face a real chance of persecution in Indonesia. Significantly, the Tribunal Member extended specific praise during the hearing for the exceptional quality and depth of the country submissions prepared by Annalise, which proved decisive in establishing credibility and securing a successful remittance.
