Overview

The applicant, a Vietnamese national, was residing and working in Bangkok, Thailand, alongside her partner, who is an Australian citizen. Eager to spend the Christmas festive period with her partner’s family in Australia, she independently lodged a Do-It-Yourself (DIY) Subclass 600 Visitor Visa application.

 

Despite providing substantial documentation indicating her intention to visit only temporarily, the Department of Home Affairs issued a generic refusal decision. The delegate claimed the applicant lacked genuine temporary entry intentions, failing to properly consider or weigh the specific merits of the evidence submitted.

  • Detailed Evidentiary Reconciliation: Methodically referencing every piece of original and new evidence to demonstrate an undeniable intent to stay in Australia temporarily and adhere strictly to all visa conditions.
  • Proactive Health Law Compliance: Addressing sensitive health criteria directly by providing definitive medical evidence confirming the applicant was free from tuberculosis, ensuring no administrative bottlenecks could delay processing.
  • Expedited Review Request: Formally advocating for a prompt and favourable reassessment to mitigate further disruptions to the family’s holiday travel plans.

Outcome

Following these robust interventions, the Department of Home Affairs overturned its previous position within just one month. In Dec 2025, the applicant was granted her Subclass 600 Visitor Visa.

 

Reflecting the strength of the legal submissions, the Department issued a highly favourable grant rather than a restrictive alternative: a visa valid for 12 months, permitting multiple entries, and allowing up to a 3-month stay period upon each individual arrival. This complete success allowed the couple to reunite with family without the shadow of an unjust refusal.
